Payment Services Agreement

1.1. The text of this Agreement is a public offer in accordance with Part 2 of Article 407 of the Civil Code of the Republic of Belarus.

1.2. This Agreement with the User defines the general terms of the provision of the services described on the information website https://market.platio.by/ of Platio Payment Technologies LLC (hereinafter, the Company), the rights and obligations of the Parties and other actions between the User and the Operator.

(hereinafter, the Payment Service Provider) and the User (an individual) who has accepted the terms of this offer.

1.4. Terms and definitions are used in the meanings established by the legislation of the Republic of Belarus, as well as:

• Service Administration — Platio Payment Technologies LLC;
• Service / Website — https://market.platio.by/;
• User — a bank payment card holder, a payer;
• Service Provider — a provider of services;
• Personal Account — the user’s secure section;
• Order — ordering a service/goods through the Service.

1.5. By accepting the Agreement, the User confirms consent to its terms.

1.6. Electronic documents have legal force.

1.7. The offer is deemed accepted after registration on the Website.

1.8. From the moment of acceptance, the Agreement is deemed concluded.

2.1. The subject is the provision to the User of access to the Service and payment services.

2.2. The Service provides the ability to:

• search for goods and services;
• place orders;
• pay online.

2.3. The Company is not liable for the goods and services of the Service Provider.

2.4. All disputes arise between the User and the Service Provider.

2.5. The User confirms their legal capacity.

2.6. The User may pay for services using bank cards and other methods available on the website.

2.7. Confirmation of payment — an electronic receipt.

2.8. The Company is not liable for failures of banks and payment systems.

3.1. Registration is mandatory.

3.2. The User provides the following data:

• full name;
• phone;
• email;
• payment details.

3.3. The User is liable for the accuracy of the data.

3.4. Access is provided via an SMS code.

3.5. Transfer of access to third parties is prohibited.

4.1. The User is obliged to review the terms before payment.

4.2. Placing an order means consent to the terms.

4.3. The Service may engage third parties.

4.4. The User consents to the processing of personal data.

4.5. The User agrees to receive:

• email notifications;
• SMS;
• push notifications.

5.1. Prices are set by the Service Provider.

5.2. Currency — BYN.

5.3. Service fee — 0.1%.

5.4. Payment processing is carried out by the acquiring bank.

5.5. The User consents to the processing of payment details.

The User is obliged to:

• comply with the terms;
• protect their data;
• provide accurate information.

The User has the right to:

• receive information on payments;
• use the service;
• dispute transactions.

The Company has the right to:

• amend the Agreement;
• suspend transactions;
• charge fees;
• transfer functions to third parties.

The Company is obliged to:

• comply with the legislation;
• ensure security;
• protect data.

7.1. The Parties are liable in accordance with the legislation of the Republic of Belarus.

7.2. The Company does not guarantee uninterrupted operation of the service.

7.3. The User is liable for their actions.

8.1. All information is confidential.

8.2. The Parties undertake not to disclose data.

8.3. Exceptions — requirements of the law.

9.1. Operator: Platio Payment Technologies LLC.

9.2. Processing is carried out in accordance with the legislation of the Republic of Belarus.

9.3. Purpose — performance of the Agreement.

10.1. The Parties are released from liability in the event of force majeure circumstances.

11.1. Claims are sent via the website or email.

11.2. Disputes are resolved in a court of the Republic of Belarus.
